The petitioner claims that the Burdwan Police have failed to retrieve her kidnapped daughter. Learned counsel for the State has produced a report dated 19th March, 2023 issued by the Inspectorin-Charge, Burdwan Police Station and the same is taken on record.

It appears that on the petitioner's complaint Burdwan Police Station Case No.1091/22 dated 20th September, 2022 under Sections 363, 365 of the IPC was registered. The victim girl was also notified as a missing person. Coke Oven Police has also registered FIR on the complaint of one Sachin Balmiki, father of Sahil Balmiki, that the latter is missing.

The victim girl has stated under Section 164 of the CrPC that she voluntarily left and is living with the said Sahil Balmiki. The police have filed final report stating mistake of fact. There is a long affair between the petitioner's daughter and the said Sahil Balmiki.

The Burdwan Police may complete the investigation into the pending FIR in accordance with law.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.
