1. Affidavit-of-service filed by the petitioners is taken on record.

2. The petitioner has filed the present writ application praying for a direction upon the authorities specifically the Unique Identification Authority of India (UIDAI) to change the name of the petitioner in Aadhar Card as Abhiroop Kundu in place of Subhrodeep Kundu and to provide a fresh Aadhar Card in the name of Abhiroop Kundu.

3. The father of the petitioner is missing since 2011 and whereabouts the mother is not known since 2019. The petitioner being the minor is residing with his maternal grandfather.

4. The main grievance of the minor is that he intends to appear in the NEET examination which is scheduled to be held in the month of May, 2026 but the N.T.A. authorities are not accepting the form as the name of minor is not matching with the name appearing in the Aadhar Card.

5. The Director (Legal) National Testing Agency is present through virtual mode and he submits that the N.T.A. authority has no objection to allow the minor to appear in the NEET examination in the name of Abhiroop Kundu.

6. He further submits that the N.T.A. authority has never denied for registration of the name of the petitioner (minor) for appearing in the NEET examination in the name of Abhiroop Kundu.

Learned counsel for the petitioner further submits that in all the documents the name of the petitioner is recorded as Abhiroop Kundu but only in the birth certificate the name of the minor is recorded as Subhrodeep Kundu @ Abhiroop Kundu and in the Aadhar Card the name of the petitioner (minor) is recorded as Subhrodeep Kundu, C/o Sikha Mondal.

8. The petitioner intends to correct his name in the Aadhar Card as Abhiroop Kundu instead of Subhrodeep Kundu but the authorities have not corrected the same.

9. Learned counsel for the respondent nos. 2 and 4 submits that unless and until the petitioner will not make the publication of correction of the name in the Official Gazette, it is not possible for the authority to correct the name of the minor in the Aadhar Card as Abhiroop Kundu.

10. She further submits that if the petitioner (minor) will furnish the Gazette notification for correction of the name, the authority will take appropriate steps for correction of the name of the petitioner (minor).

11. Heard the learned counsel for the respective parties.

12. The Director (Legal) National Testing Agency has categorically submitted before this Court the N.T.A. Authority has never denied the petitioner for accepting the application for registration of his name for appearing in the NEET examination for the year 2026, in the name of Abhiroop Kundu.

The petitioner is given liberty to submit his application through online before the last date with the name appearing in the educational certificate i.e., Abhiroop Kundu and if any application is submitted, the National Test Agency shall accept the application of the petitioner and to allow the petitioner to appear in the NEET Examination2026.

As regards the correction of the name of the minor in the Aadhar Card, the petitioner is at liberty to make appropriate publication in the Gazette and if the Gazette is published, the petitioner shall apply for correction in the name.. The Gazette notification shall be furnished to the respondent nos. 2 and 4 and the respondent nos. 2 and 4 shall take appropriate steps in correction of the name of the petitioner in the Aadhar Card as Abhiroop Kundu instead of Subhrodeep Kundu in terms of the Gazette notification.

The respondent nos. 2 and 4 submits that on earlier occasion, this Court by an order dated 27th January, 2026 has passed an order directing the authority to correct the name of the petitioner (minor) in the Aadhar Card but the authority could not be able to correct the Aadhar Card due to noncompletion of all formalities by publication of the name in the Gazette notification, thus, the order dated 27th January, 2026 is modified by this order.

16. WPA No. 3217 of 2026 is disposed of.

17. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
