The State of West Bengal & Ors.

Despite service, none appears on behalf of the respondents. Affidavit-of-service is taken on record. The father of the petitioner who was an employee of Chachanda Gram Panchayat, District-Murshidabd, diedin-harness on October 30, 2012. The petitioner submits that the state authorities had failed and neglected to consider the petitioner's application for compassionate appointment.

It appears that the Block Development Officer, Samserganj Development Block, Murshidabad, sent a modified proposal to the District Panchayat and Rural Development Officer, Murshidabad on March 16, 2015 with regard to the appointment of the petitioner on compassionate ground. Since then, the authorities have not taken any steps either to appoint the petitioner or intimate the petitioner about the reasons for the delay. The three-

man committee allegedly found the petitioner to be eligible.

The petitioner categorically submits that there are vacancies in the died-in-harness category in the district, especially in the Chachanda Gram Panchayat where the petitioner's father worked.

Under such circumstances, the District Panchayat and Rural Development Officer, Murshidabad will intimate the petitioner what steps had been taken with regard to the consideration of the prayer for appointment of the petitioner under the died-in-harness category. Such intimation shall reach the petitioner within a period of two months from the date of communication of this order. In case the petitioner is found to be eligible in all respects, steps shall also be taken to appoint the petitioner in accordance with the vacancies available for appointment under the died-in-harness category and as per the serial number of the candidate.

A copy of the writ petition along with a server copy of this order be served upon the District Panchayat and Rural Development Officer, Murshidabad.

This Court has not expressed any opinion on the merits of the claim of the petitioner.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
