DSG, Mr. Sukanta Chakraborty ......for the CBI This Court had passed an order on 22nd December, 2022 in an earlier writ petition (WPA 25255 of 2022) filed by the parties wherein the one-man Committee was directed to hold a public auction within a certain date and the CBI was directed to hand over the key of the room to the representative of the one-man Committee. The one-man Committee was also directed to sell the articles found in the residential flat after making an inventory of the same.

Learned counsel appearing for the petitioners, the CBI and the one-man Committee

submit that all the directions passed in the order dated 22nd December, 2022 have been complied with. The key of the residential flat had also been handed over by the CBI to the one-man Committee and then to the petitioners. Learned counsel for the parties submit that the volume of papers which are presently lying in the flat are required to be disposed of.

The order passed by this Court had specifically recorded that the CBI was not interested in the articles lying in the flat since these articles had not been seized by the CBI. The Learned DSG appearing for the CBI takes the same stand today.

Hence, after hearing learned counsel, there cannot be any difficulty in giving direction to the petitioners to destroy the papers which are presently lying in the flat.

WPA 3093 of 2023 is accordingly disposed of with liberty to the petitioners to destroy the papers which are presently lying in the flat by whatever means the petitioners deem fit.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
