Affidavit-of-service filed by the learned Advocate for the petitioner in Court today be taken on record. The petitioner is aggrieved by the fact that the private respondent has been engaged as ASHA Karmee for the Harinbari Sub Centre under Ramkarchar Gram Panchayat, South 24 Parganas. It is submitted that no panel has been published.

Mr. Manas Kumar Kundu, Counsel for the State produces a panel in which the first candidate is Pratima Mondal, the private respondent no.8 herein. The person in the second position and consequently the first wait listed candidate is Manasi Mondal. The petitioner is in the third position in serial number and the second wait listed candidate.

The panel produced by the Counsel for the State in Court today is kept with the record.

The contentions of the petitioner are, therefore, incorrect. Hence, no relief can be granted to the petitioner.

In view of the above, the instant writ application must fail and is hereby dismissed.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
