PP Mr. Kaushik Kundu Mr. Sourat Nandy ...for the State In this application, the petitioner has prayed for a direction upon the court below for expeditious disposal of G.R. case no. 7093 of 2019, presently pending before the learned Judicial Magistrate, 5th Court, Barrackpore. It is submitted on behalf of the petitioner that the FIR was lodged on 26th November, 2019 and after completion of investigation, the charge-sheet was submitted on 26th August, 2021. Thereafter, the court below framed charge on 8th February, 2023 but till date, no witness has been examined. The prosecution proposes to examine six witnesses and as such, a necessary direction may be passed upon the court below for expeditious disposal of the aforementioned case.

Having heard learned counsel for the petitioner and the State, I find that the prayer made by the petitioner is innocuous and required to be allowed for securing the ends of justice considering the long pendency of the case.

In view of above, the instant application being CRR 645 of 2026 is hereby disposed of with a direction upon the court below to make best endeavour to expedite the hearing of the aforesaid G.R. case no. 7093 of 2019 and to make best effort to conclude the trial preferably within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties. This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
