By order dated 4th August, 2022, on the submission made by the counsel for the alleged contemnor, the contempt application was disposed of. Subsequent to the order dated 4th August, 2022, petitioner has filed the instant application for recalling of the order dated 4th August, 2022. When the application filed by the petitioner for recalling of the order dated 4th August, 2022 was served upon the alleged contemnor, they have assured the petitioner
that they will provide the mutation certificate to the petitioner in terms of the order passed by this Court. Today when the matter is called, the counsel for the alleged contemnor has produced the original mutation certificate issued by the Chairman, Uttarpara Kotrung Municipality dated 16th January, 2023 showing that the alleged contemnor has supplied the copy of mutation certificate to the petitioner. Counsel for the petitioner present in Court has submitted that he has received the certificate of mutation issued by the Chairman, Uttarpara Kotrung Municipality.
As the petitioner has received the mutation certificate and counsel for the petitioner submits that now respondent/contemnor is complied with the order and thus the instant application can be disposed of. In view of the submission made by the respective parties, the application filed by the petitioner being CAN 2 of 2022 is disposed of.
Mutation certificate along with the other documents be kept with record.
