Mr. Kalyan Kr. Panda along with Mr. S. C. Dhara, learned advocates appear on behalf of the opposite party and submit that the matrimonial suit sought to be withdrawn and transfer has already been decreed. A copy of the ex parte decree dated November 27, 2019 passed in the relevant matrimonial suit being Matrimonial Suit No. 34 of 2017 is filed, which is taken on record.
Mr. Pinaki Ranjan Chakraborty, learned advocate appearing on behalf of the petitioner submits that he has no knowledge about such decree, but submits that when the suit has already been decreed the application has become infructuous.
C.O. 311 of 2018 is therefore dismissed as infructuous without any order as to costs.
