Mr. Sandipan Pal Mr. Debobrata Sardar ... for the petitioners Learned advocate appearing for the petitioners submits that there is a typographical error in the cause title of the civil revisional application. He prays for leave to correct the same.

Learned advocate on record of the petitioners is permitted to amend the cause title of the civil revisional application, here and now.

This application under Article 227 of the Constitution of India is at the instance of the respondent in Misc. Appeal No. 21 of 2018 praying for a direction upon the learned Additional District and Sessions Judge, Fast Track Court, 2nd Court, Diamond Harbour, South 24 Parganas to dispose of the miscellaneous appeal expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.

However, the learned advocate appearing for the petitioners shall be obliged to forward

a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. From the order-sheets appended to this application this Court finds that the respondents/petitioners herein prayed for time on various occasions before the learned trial judge. In view thereof, this Court is not inclined to pass any peremptory direction for expeditious hearing of the miscellaneous appeal.

However, taking into consideration the fact that the miscellaneous appeal is pending from the year 2018, the learned Additional District and Sessions Judge, Fast Track Court, 2nd Court, Diamond Harbour, South 24 Parganas is requested to dispose of the same as expeditiously as possible after the miscellaneous appeal is made ready for hearing without granting any unnecessary adjournment to either of the parties.

With the above observations and directions, C.O. 471 of 2025 stands disposed of.

No order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
