Petitioner Mr. Mani Sankar Chattopadhyay Mr. Subhasish Shaw ... for the Petitioner The petitioner has challenged the order dated 1.12.2022 passed by the ld. ACJM, 2ndCourt, Lalbagh. By the said order, the ld. ACJM was pleased to direct the present petitioner to pay a sum of Rs. 5,000/- per month to the wife and Rs.4,000/- per month to the minor daughter as interim maintenance during pendency of the case.

Having considered the reasons so assigned by the ld. Magistrate while granting such interim award, I do not find that there is prima facie any illegality as the husband happens to be a teacher earning around Rs.37,625/- per month.

If there are any liabilities, which the husband/petitioner (before this court) intends to urge, in that case, the husband would be at liberty to take out an appropriate application under section 25 of the PWDV Act.

With the aforesaid observations, CRR 562 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
