None appears for the appellant. Mr. Prasun Dutta along with Mr. Pravas Bhattacharya, learned advocates appear for the State. The appeal is listed today for consideration of the report called for from learned Additional Chief Judicial Magistrate, Rampurhat. The report of learned Additional Chief Judicial Magistrate, Rampurhat, in-Charge received through the District Judge, Birbhum and placed before this Court by the Assistant Registrar dated 11.1.2022 is taken on record.

It appears from the report that notice has been served upon Mr. Vinay Mishra, learned advocate for the appellant. It has further been reported that the appellant, Kawsar Sk. has expired on 11.1.2011. A copy of the death certificate has been produced.

Considered the same.

In view of the death of the appellant, the appeal filed by him against his conviction and sentence has abated under Section 394(2) of the Cr.P.C. The appeal is accordingly disposed of.

Let a copy of this order along with Lower Court Records in connection with Sessions Case No. 99 of 1992 be returned to the Court of learned Additional Sessions Judge, Birbhum at Rampurhat. (Ananda Kumar Mukherjee, J.)
