Mr. Gobinda Chandra Baidya ....for the petitioner Ms. Joyee Maiti ...for the Pollution Control Board The Uluberia Police Station, Howrah Rural District has filed a report dated 07.02.2023. It appears that the trees that have been cut on the land in question may have been cut off a couple of years ago.

This Court does not wish to enter into the land dispute between the petitioner and the private respondent. The land in question occupied by the petitioner belongs to the PWD.

The Executive Engineer, PWD (Roads), Uluberia Highway Division has requested the BL & LRO, Uluberia-I, Howrah to demarcate the land in question at plot no. 300, J.L. No. 48, MouzaDalsalap. The BL & LRO, Uluberia shall, within 7 days demarcate the said land in question.

The Executive Engineer, PWD shall thereafter immediately take over physical possession of the land in question and secure the same with an appropriate boundary wall. All encroachers shall be removed

therefrom in accordance with the provisions of the concerned statute.

The District Magistrate, Howrah shall oversee the entire operation.

The report of the Uluberia Police Station that of the Jr. Engineer, PWD dated February 6, 2023, Uluberia PS dated February 7, 2023 and the BL & LRO dated November 26, 2021 are kept with the record.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
