Mr. Subhas Chandra Atha Ms. Payel Pramanik ... for the petitioners The revisional application earlier appeared on 19th February, 2024, when there was none to represent on behalf of the petitioners.

Learned advocate for the petitioners drew the attention of this court to the seizure list with reference to G.D. entry no.748 dated 13.06.2023 of Beliatore Police Station at the bottom of the seizure list. Learned advocate also referred to the statement under Section 161 of the Code of Criminal Procedure, which has been enclosed. However, I find no injury report has been enclosed along with the documents, although in the charge-sheet, CSW 8/Dr. Kaliram Murmu was the Medical Officer. A bare glance of the statement under Section 161 of the Code of Criminal Procedure reflects that there are allegations that the victim was assaulted with a bamboo stick for which she had sustained bleeding injury on the head. Having considered the issues so canvassed which are premature questions of facts, I am not inclined to interfere at this stage. Petitioners are granted liberty to take up all the issues at the stage of consideration of the charges before the learned trial court.

Needless to mention that the learned trial court will dispose of any of the application being filed at the instance of the petitioners, independently without being influenced by the observation of this court while disposing of the revisional application. Accordingly, the revisional application being CRR 564 of 2024 is disposed of.

All parties are to act on the basis of the server copy of the order.
