Mr. Golam Mastafa Mr. Tarasankar Samanta ...for the Petitioner Mr. Suman Ghosh Mr. Sidharta Ghosh ... for the State Mr. Arkadipta Sengupta Ms. Ria Naskar ...for the Respondent No.5&6 Petitioners complain that the private respondent nos. 5 and 6 are trying to throw away them from the residence after the property was gifted in favour of them. Additionally, it has been submitted that there has been threats, abuse and harassment inflicted by the private respondents upon the petitioners who are senior citizens.

State has submitted a report. Report reflects that the police authorities enquired into the issue and found the same to be a family dispute in spite of the same a proceeding under Section 126 of BNSS has been drawn up against the private respondents.

Learned Advocate for the respondent nos. 5 and 6 submits that the allegations made by the petitioners are false, frivolous and vexatious. Other relations are interfering which have prompted the petitioners to act adversely against them. There has been no interference in respect of the life and liberty of the petitioners at the behest of the private respondents.

I have considered the submissions of the respective lawyers appearing for the petitioners, state as well as for the private respondents and I am of the view that since the petitioners are senior citizens if they are subjected to any harassment and an information is furnished to the police authorities, police authority would ensure that there is no breach of peace and/or tranquility at the behest of the private respondents and/or any untoward incident results because of inimical relationship presently existing between the parties.

With the aforesaid observations WPA No.

3271 of 2025 stands disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the Server Copy of this order duly downloaded from the Official Website of this Court.
