Pursuant to the direction passed by this Court on 21st February, 2025, learned advocate appearing for the State has submitted a report prepared by Inspector-in-Charge, Malipanchghora Police Station. Let the same be kept with the record.

A copy of the said report be handed over to the learned advocate appearing for the petitioner. Police authorities have conducted an enquiry and have arrived at their own opinion. Having regard to the medical documents which have been enclosed along with the report, I am of the view that the incident complained of by the petitioner cannot be ruled out. Accordingly, petitioner, if he is aggrieved, he would approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate will see the report which is submitted before this Court. If required, learned Magistrate would be at liberty to further assess the

circumstances and pass necessary direction as he deems fit and proper.

Police authorities at the relevant point of time have drawn up proceedings under Section 126 of BNSS. Police authorities would continue their surveillance to ensure that no further untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations, the writ petition being WPA 3360 of 2025 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
