Subir Deb v. State Of West Bengal And ORS.
08.07.2024 Sl. No.6(DL) srm W.P.A. No. 3146 of 2024 Sri Subir Deb
Versus
The State of West Bengal & Ors.
Ms. Srijani Mukherjee, Mr. Lalratan Mandal ...for the Petitioner.
The petitioner is aggrieved by the failure on the part of the respondents in disposing of the petitioner's application for grant of licence for retail sale of liquor and certain other intoxicants. The petitioner contends that the regular enquiry was held, but the petitioner was informed that the matter is still under process. Without going into the genuineness of the claim of the petitioner and the right of the petitioner for grant of licence, the writ petition is disposed of with a direction upon the appropriate authority to process the application of the petitioner in accordance with law and dispose of the same by informing the petitioner the fate of such application within a period of two months from the date of communication of this order. If the authority finds that the petitioner's licence cannot be granted, then sufficient reasons should be provided to the petitioner. If the authority finds that the petitioner's application
is in order and the petitioner fulfils the rules governing grant of licence for retail sale of liquor and certain other intoxicants, the same shall be granted. The entire exercise shall be completed within the period mentioned hereinabove.
The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are directed to act on the basis of the server copy of this order.
