Mr. Abhishek Sinha Ms. Rituparna Saha ... For the State Report submitted by the State is taken on record. On merits, the crime is extremely heinous and material available on record sufficiently links the petitioner to the alleged offence. The petitioner who appears to be the paramour of the victim's mother was found to have been taking the victim to the railway tracks where his dead body was found.
With regard to the progress of trial, 7 out of 37 witnesses have been examined. The delay in progress of trial can be attributed to the petitioner as well as the prosecution. It also appears that on few dates the Court was vacant and the matter also could not be taken up for hearing due to Covid 19 pandemic.
Considering the involvement of the petitioner in the alleged crime, prayer for bail is rejected at this stage.
In view of the period of detention of the petitioner, learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law.
The application for bail is disposed of.
