The grievance of the writ petitioner is that despite the petitioner qualifying in the first two rounds of MopUp counselling and obtaining better ranks in both the rounds of counselling, the petitioner, being a scheduled caste candidate, was given admission in a private college.

According to learned counsel appearing for the writ petitioner, the petitioner should be given admission in a government college since the petitioner is a scheduled caste candidate holding a rank eligible for such admission.

After hearing learned counsel appearing for the respondents, it appears that the Central Selection

Committee which is constituted for counselling in the concerned Nursing (UG), 2021 Course is the proper authority to decide the grievance of the petitioner. The Central Selection Committee being respondent no.3 is not represented.

W.P.A.3041 of 2022 is accordingly disposed of with a direction on the respondent no.3 to consider and dispose of the representation of the writ petitioner within a period of two weeks from the date of receipt of such representation by way of passing a reasoned order after hearing all concerned parties including the petitioner. The reasoned order shall be made available to the petitioner within four days from the date such order is passed.

It is made clear if the petitioner is found eligible for the existing vacancies with any of the government colleges for the concerned post, the respondents shall ensure that the petitioner is given admission in such government college.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
