Petitioner(s) Mr. Debapriya Majumder ... for the Petitioner(s) Mr. Arindam Sen Mr. Sobhan Gani ... for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are similarly situated as the other accused person who has been granted bail in CRM (NDPS) 103 of 2026.

Learned advocate for the State opposes the prayer for bail but is unable to distinguish the locus of the present petitioners as that of the person who has been granted bail. Having regard to the same, I am of the view that the petitioners may be enlarged on bail.

Hence, the prayer for bail of the petitioners is Allowed.

Accordingly, the petitioner viz, Jatan Das and Bithika Biswas shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each,

with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act-cumlearned Additional District & Sessions Judge, 4th Court, Alipore.

If on bail, the petitioners shall be physically present on each and every date of the trial so fixed by the learned trial court and shall not leave the jurisdiction of the district of South 24 Parganas without prior intimation to the learned Special Court.

Accordingly, CRM(NDPS) 295 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
