Heard learned counsels for the parties.

The petitioner seeks consideration of his application for issuance of stage carriage permit submitted on 17th January, 2024 upon arising of one vacancy in the route due to cancellation of a permit by the RTA Board by a resolution dated 10th October, 2023.

Learned counsel for the respondents submits that the 2nd respondent be directed to consider the application, in accordance with law.

In view of the above, the writ petition is disposed of directing the 3rd respondent to accept the application submitted by the petitioner dated 17th January, 2024 upon the petitioner depositing requisite fees, within two weeks from date.

Upon acceptance of the same the 2nd respondent is directed to consider and dispose of the application within eight weeks from the date of receipt thereof upon affording

reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
