The petitioner says that he has been falsely implicated. He is in no way connected with the alleged rape of the victim girl. He is in custody for one year two months. Witness action has not started. He prays for bail.

Learned Advocates for the State and the defacto complainant, while opposing the bail prayer, draw our attention to the material in the case diary.

We have seen the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure. We have also seen the medical examination report. It appears that the victim girl is intellectually challenged. She was about 17 years 11 months old at the time of the alleged incident. We have also seen statements of eye-witnesses recorded under Section 164 of the Code of Criminal Procedure implicating this petitioner by name.

In view of the availability of prima facie incriminating material against the petitioner and noting that witness action is scheduled to begin on March 13, 2025, we are not inclined to enlarge the petitioner on bail, at this stage. 5.

CRM (DB) 562 of 2025 is, thus, dismissed.

However, the learned Trial Court is directed to expedite the trial without granting unnecessary adjournments to either of the parties and if necessary, by fixing frequent schedules of 3/4 dates for examination of the witnesses.
