Mr. Abhijit Ray Mr. Santu Nandy ...for the petitioner This civil revision application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon Learned Civil Judge (Sr. Division), Sealdah to dispose of TS No. 367 of 2023 expeditiously.

Learned advocate appearing for the petitioner submits that though repeated opportunities were granted to the defendant/opposite party to file the written statement, the written statement has not been filed. He further submits that learned trial judge by an order dated June 22, 2026 fixed September 3, 2026 for ex party hearing of the suit.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned

advocate representing the opposite party before the learned trial judge forthwith.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 514 of 2026 stands disposed of by requesting the Learned Civil Judge (Sr. Division), Sealdah to make an endeavour to dispose of TS 367 of 2023 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
