For the alleged contemnors It appears from the order dated 23rd December, 2008 that two orders respectively dated 17th January, 2007 and 23rd March, 2007, being the subject matter of the contempt petition, had been complied with at a belated stage by issuance of a cheque of Rs.1,04,554/- in favour of Sree Digambar Jain Vidyalaya, P-34/35, Cotton Street, Kolkata. The contempt petition was kept pending as the alleged contemnors intended to file an affidavit-inopposition to deal with the aspect of delay in complying with the orders of this Court.

No affidavit appears to have been filed. The applicant/petitioner remains unrepresented on previous occasions when the matter was taken up.

This demonstrates that the applicant/petitioner is not interested to proceed any further with the contempt petition.

On behalf of the alleged contemnors, unconditional apology is tendered through their advocate. Taking note of the disinclination on the part of the applicant/petitioner and the unqualified apology tendered by the alleged contemnors for the delay in complying with the order, the contempt proceedings are dropped. The contempt petition is disposed of without any further order.

Rule stands discharged accordingly.
