(ML) (ML) 11.07.2025 11.07.2025 Ct. No. 18 (ARPAN) CPAN 254 of 2025 In W.P.A. 5160 OF 2023 Sisir Kumar Das Vs.

Sri Brindaban Mitra, District Inspector of Schools (S.E.), Purba Bardhaman Mr. Binit Kumar, Adv.

...for the Applicant Mr. Arindam Chattopadhyay, Adv.

Ms. Lipika Chatterjee, Adv.

...for Alleged Contemnor 1.

Affidavit-of-service filed on behalf of the applicant is taken on record.

2.

Contempt application is heard in presence of the learned advocates representing the applicant and alleged contemnor.

3.

On behalf of the alleged contemnor a report is filed dated 10th July, 2025 enclosing medical report dated 15th May, 2025 issued by Chief Medical Officer of Health, Purba Bardhaman.

4.

On perusal of medical report dated 15th May, 2025 it appears that said medical report does not justify transfer of the petitioner on medical ground. Therefore, this Court finds that there is no contempt on the part of the alleged contemnor.

5.

Hence, contempt application stands disposed of and contempt proceeding stands dropped.

6.

However, this order shall not preclude the applicant to take steps, in accordance with law.

7.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
