Mr. Anindya Bose Mr. Diptendu Mondal ...... for the petitioner Mr. Susovan Sengupta ......... for the State The petitioner is the son of a deceased dealer. The Court No. 24 24.02.2022 (Item No. 104) (AB) dealer expired on 25th May, 2017.

The petitioner has alleged in the writ petition that the private respondent herein i.e. the brother of the petitioner compelled the petitioner and his mother to affirm the "No Objection" certificate by force suppressing the actual state of affairs by making a false assurance that they would never be deprived of the benefits to be accrued out of the FPS shop.

Presently, the grievance of the petitioner is that his brother is not acting with the assurance that was given and is not paying his share of the proceeds from the said business.

The petitioner alleges that he made representation through his learned advocate on 1st February, 2022. There is no proof of service of the said representation to the Deputy Director (License). The license is yet to be granted in favour of the private respondent herein.

From the submission made on behalf of the parties and upon perusal of the documents annexed to the writ

petition it appears that there is a private dispute between the two sons of the deceased dealer.

It will be open for the concerned respondent authority to take into consideration the grievance of the petitioner, if a formal application is made before the said authority, after giving an opportunity of hearing to all the parties.

The writ petition stands disposed of.

Affidavit of service filed in Court today is taken on record.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
