Mr. Ganguly, learned senior advocate appearing for the petitioner submits that the case relates to Bally P. S. Case No.
of dated 07-11-2002 under Sections 120B/406/411/410/420 of the Indian Penal Code. As there has been a compromise between the parties and the joint compromise petition has been filed in CRR 218 of 2003, I am of the view that the same outcome must follow in the present revisional application.
A photocopy of the demand draft bearing no. 331791 drawn on HDFC Bank Limited, Stephen House Branch, 4 B B D Bag(E), Kolkata which has been handed over by the learned advocate for the complainant be kept with the record. Mr. Anwar Hossain, learned advocate appearing for the State has also submitted a report which was prepared by the Inspector-in-Charge, Bally Police Station, Howrah. Let the report submitted by learned advocate for the State be kept with record.
Accordingly, further continuance of the proceeding in connection with Bally P. S. Case No. 210 of 2002 dated 0711-2002 under Sections 120B/406/411/410/420 of the Indian Penal Code is redundant in the changed circumstances. Consequently, further proceedings including all orders passed therein are hereby quashed.
As such, the revisional application being CRR 226 of 2003 is allowed.
All connected applications, if any, consequently are disposed of.
Department is directed to communicate this order to the learned court below.
