The application being CAN 1 of 2018 (Old No.

CAN 2775/2018) is for recall of the order dated 7th May, 2018 passed by a coordinate Bench.

Previously on two occasions the application was taken up for consideration when no one appeared for the applicant and no accommodation was prayed for.

In view of no representation on behalf of the applicant on previous two occasions this Court directed the learned advocate representing Bidhannagar Municipal Corporation being the respondents to serve notice upon the learned advocate for the applicant.

Today learned advocate for the Corporation submits that attempt was made to serve notice dated 13th June, 2023 upon the learned advocate for the petitioner namely Mr.Krishnadas Poddar, but he refused to accept the same.

It appears that applicant has lost interest.

The application stands dismissed.

However, there shall be no order as to costs. Unserved notice dated 13th June, 2023 of the learned advocate representing the Corporation is taken on record.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
