The postal envelopes served to the respondent Nos. 9 and 10 have come back un-served with the endorsement 'left'.
The petitioner alleges illegal and unauthorized construction in the premises No. 18/2, Kumar Para Lane, Howrah, Ward No. 22 under the jurisdiction of the Howrah Municipal Corporation.
On the allegation of unauthorized construction being carried thereon, the men and agents of the Howrah Municipal Corporation inspected the site and a hearing was also conducted.
It has been submitted that all the parties including the respondent Nos. 9 and 10 were present in the hearing.
The fate of the hearing has not yet been communicated to the parties.
Learned advocate appearing for the Howrah Municipal Corporation submitted that the same will be communicated to the parties immediately.
The petitioner submits that even though stop work notice was issued and hearing conducted, the private respondents are carrying on with the unauthorized construction in such a manner that the sewerage line of the petitioner has been blocked. The same is creating an unhygienic atmosphere in the locality.
In view of the submissions made hereinabove, the competent authority of the Howrah Municipal Corporation is directed to communicate the reasoned order to the parties at the earliest, but positively within a fortnight from date.
The Howrah Municipal Corporation is also directed to ensure that the sewerage connection of the petitioner is not blocked by any person and the dirty water does not remain stagnant in the area in question. The writ petition stands disposed of.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
