.... Petitioner Mr. Kaustav Das ...for the petitioner Mr. Subhamay Bhattacharya Ms. Trisha Rakshit ..for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner is a clerk working with an advocate. He has been falsely implicated in this case.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the FIR, the statements of the victim and the Warisan certificate in question. The signature present there of the de facto complainant was forged. An expert's opinion is forthcoming. But, from a visual comparison, the signature contained in the Warisan certificate is way different from the one present in the FIR.
Considering the above and the other incriminating materials available in the case diary, I do not consider that this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
