No. 29 KAUSHIK Allowed C.R.M.(A) 905 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Pursurah Police Station Case No. 168 of 2021 dated 01.12.2021 under Sections 379/411/414 of the Indian Penal Code, 1860 and under Section 21(i) of the Mines and Minerals (Development and Regulations) Amendment Act, 2015. And In Re : Manik Laga ...... petitioner Mr. Niladri Sekhar Ghosh ....for the petitioner Mr. Madhusudan Sur Mr. Dipankar Pramanick ....for the State Considering the fact that the owner of the leasehold right was granted anticipatory bail by the Coordinate Bench in CRM 8154 of 2021 on December 17, 2021 and considering the fact that the petitioner herein is the driver of the vehicle and considering the fact that the police filed charge-sheet, we grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of

Criminal Procedure, 1973 and on condition that the petitioner shall appear before the jurisdictional court on every date fixed and pray for regular bail within a period of four weeks from date.
