Petitioner is aggrieved by the fact that inspite of informing the police authorities no steps have been taken and the petitioner is being attempted to be dispossessed from his possession.

Learned advocate for the respondent nos. 7 to 9 dispute such contention and submits that they are in possession of the property. So far as the right, title, interest, possession, occupation and usage is concerned Civil Court is sole authority of deciding the same. Report has been submitted by the police authorities, wherein police authorities apprehending breach of the peace and/or tranquility has already drawn up proceedings under Section 126 of the BNSS. Police authorities will continue their surveillance and ensure that there is no breach of the peace and/or tranquility or

any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations, WPA 3347 of 2025 is disposed of.

Report submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
