Petitioners have challenged an acquisition proceeding initiated in the year 1956 and has sought for a declaration that the said acquisition is non est in the eye of law and for a direction to initiate a fresh proceeding.. Learned advocate appearing for the petitioners submits that the compensation amount has not yet been paid to the petitioners.

Petitioner no. 1 is a private limited company. It appears that an Award has been declared in favour of the petitioner company. The amount has also been deposited in accordance with law as the petitioners did not receive the compensation amount.

Petitioners have approached this Court only in the year 2026 alleging that the notice to receive compensation has not been served.

This Court is not inclined to accept such submission at such a belated stage.

It will be open to the petitioners to take appropriate steps for release of the money which is lying in deposit in accordance with law.

With the above observations, this writ petition stands disposed of.
