No. 29 KAUSHIK REJECTED C.R.M.(A) 624 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kaliganj Police Station Case No. 483 of 2022 dated 23.07.2022 under Sections 21(C)/28/29 of the Narcotic Drugs and Psychotropic substances Act.

And In Re : Manirul Sekh @ Monirul ...... petitioner Mr. Ali Ahsan Alamgir Ms. Rabia Khatoon ....for the petitioner Mr. Saibal Bapuli Mr. Arani Bhattacharya ....for the State There are call details recording of telephonic conversation between the petitioner and the person arrested with commercial quantity of narcotic. The police seized commercial quantity of narcotic.

In such circumstances, the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 624 of 2023 is dismissed.
