The writ petitioners are represented by their learned advocates.

The affidavit-of-service on behalf of the petitioners as filed today be taken on record.

None appears on behalf of the State/respondents in spite of service.

Accordingly, the instant matter is taken up for hearing in absence of the respondent/State of West Bengal.

At the very outset, Mr. Guha, learned advocate for the writ petitioners submits that in the meantime the present writ petition has become infructuous. However, it is contended that as per the notification of the respondents, the writ petitioners have deposited a sum of Rs. 20,000/- in cheque towards Earnest Money Deposit and that said money is still lying with the respondent no. 3 authority.

In view of the submission of Mr. Guha, the instant writ petition is dismissed being infructuous with a direction upon the respondent no. 3 i.e., Deputy Director of Horticulture Bankura, Department of

Food Procession Industries and Horticulture, Collectorate Compound, P.O & District- Bankura, Pin - 722101 to return the Earnest Money Deposit Rs. 20,000/- to the instant writ petitioner positively within three months from the date of communication of this order.

With the aforementioned observation, the instant writ petition being WPA 2143 of 2018 is, accordingly, disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
