Mr. Lal Monhan Basu .....For the State The petitioner is aggrieved by an order dated 25th April, 2023, issued by the State, whereby the petitioner's prayer for compassionate appointment has been rejected.

Mr. Sen, learned advocate appearing for the State, has rightly submitted that the post of Assistant Executive is under the State of West Bengal. In other words, the deceased employee was not in the employment of the Gram Panchayat but was an employee of the State Government.

In view of the above, this Court is of the opinion that the petitioner ought to have challenged the order of rejection before the West

Bengal State Administrative Tribunal, which is the competent forum to adjudicate such disputes.

Accordingly, WPA 3341 of 2025 is dismissed.

This shall not preclude the petitioner from approaching the appropriate forum in accordance with law.
