Learned advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused person who has been granted anticipatory bail and the issue arose because of business rivalry.

Mr. Sagar Saha, learned advocate, was directed to represent the State. His appearance may be regularized by the concerned authority.

Learned advocate for the State, on the other hand, produces the case diary and draws the attention of the Court to the statement of eyewitness, namely, Safiron Bibi. I find that the petitioner is the person who inflicted the vital blows, according to the statement under Section 183 of the BNSS. The injuries inflicted upon the victim are grievous and it has

been submitted that the injured was not even in a position to give his statement. According to the investigating agency, the injured is still admitted in the hospital.

It has also been submitted on behalf of the petitioner that the case has been committed to the court of sessions. Having considered the stage of the case, the gravity of the offence and the complicity of the present petitioner, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM(M)445 of 2026 is rejected.

Memo of Evidence submitted by the State be kept with the record.
