Learned Counsel for the petitioners submits there is dispute between the parties over use of common pathway. They pray for anticipatory bail.

Learned Counsel for the State opposes the prayer for anticipatory bail.

We have considered the materials on record including the injury report. It shows hospitalization and internal swelling of the brain tissue. In view of the aforesaid nature of injury on a vital part of the body we are not inclined to grant anticipatory bail to the petitioners.
