Mr. Bidyut Kr. Haldar Mr. Indranil Haldar ... for the petitioner Mr. Om Narayan Rai Mr. Prashant Agarwal ... for the CESC The petitioner is aggrieved by a letter dated 30.12.2019 issued by the CESC. The petitioner had applied for an independent connection/meter.

At the Bar, it is submitted that in the alternative an existing electricity connection in the name of one Raju Barai from whom the petitioner received supply may be transferred to him since the said Raju Barai has left the premises.

The licensee has found that the petitioner may be applying for a fresh connection with an oblique motive of load splitting and hence rejected the application for fresh electricity connection.

Since the petitioner has an effective alternative remedy under Clause 14 of the West Bengal Electricity Regulatory Commission (Recovery of Expenditure for Providing New Connections) Regulations, 2013, let the petitioner move before the Ombudsman for having his grievances against the CESC redressed.

In the event, the petitioner approaches the

Ombudsman as above within a period of 7 days from date, the latter shall decide the matter mandatorily and positively within a period of two months thereafter. After hearing all the parties, the Ombudsman shall pass a reasoned order and shall communicate the same to all the parties within seven days thereof.

With the above observations, the instant writ application stands disposed of without any order as to costs.

All parties shall act on the Web copy of this Order accordingly.
