The petitioner is aggrieved by the inaction of the police authorities as such has approached this Court. According to the petitioner, she has been subjected to torture by the respondent nos. 2 and 3, who happens to be the son and daughter-in-law of the present petitioner.

It has been alleged that the respondent nos. 2 and 3 have engineered harassment, insult and physical torture which on being complained to the police authorities, have not been addressed till

date.

State has submitted a report which reflects that there has been continuous family dispute pursuant to which there were cases. To that effect, report reflects that Haridevpur P.S. Case No. 592 of 2020 dated 24.11.2020 was registered for investigation against the respondent no.2.

Presently, on 26th February, 2025, Haridevpur P.S., Case No. 157 of 2025 has been registered for investigation under the various provisions of BNS and the Special Law.

Learned advocate for the petitioner submits that even if a case has been registered, but, no proper steps have been taken.

Be that as it may, the police authorities would ensure that proper steps are taken in connection with the criminal case which has been registered.

The petitioner would be at liberty to approach the jurisdictional Magistrate after 45 days to have an information in respect of the progress of the case.

In view of the nature of the dispute, if the petitioner, if so advised, would approach the appropriate authorities/Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and, if any direction is passed from the appropriate authority/Tribunal upon the police authorities to render assistance, the police authorities would take steps accordingly.

In the meantime, the police authorities would oversee that there is no breach of the peace and tranquility as also no untoward incident resulting because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 3638 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
