The learned Counsel for the petitioner submits that the petitioner is in custody since 09.05.2020 and the case has been committed to the Court of Sessions and the trail has commenced where three witnesses have already been examined. Mr. Partha Pratim Das, learned Counsel appearing on behalf of the State opposes the prayer for bail and draws the attention of the Court to the complicity of the present petitioner in assaulting the deceased.

Having regard to the nature of allegations, the gravity of the offence, the complicity of the present petitioner and the incriminating materials appearing against the petitioner, we are not inclined to release him on bail. Accordingly, the petitioner's prayer for bail is rejected.

However, learned Trial Judge is directed to complete the examination of the prosecution witnesses by December, 2021.

With the aforesaid observation, the application for bail, being CRM 1455 of 2021, is disposed of.
