IN THE HIGH COURT AT CALCUTTA
CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE W.P.A. No. 3865 of 2021 Smt. Tapasi Saha Vs.
State of West Bengal & Ors.
Mr. Jagabandhu Roy, Ms. Madhuri Das, Ms. Manasi Roy ... for the petitioner Mr. Sk. Md. Galib ...for the respondent-authorities Mr. Joy Chakraborty, Mr. Sandip Dinda ...for the private respondents The grievance of the petitioner, who is around 62 years old, is that, she is not being accommodated by her son and daughter-in-law in their residence. Criminal complaints were also lodged by the petitioner before the appropriate police-authorities, but tono effect, as per the submission of the petitioner. Such contention is controverted by learned counsel for the State as well as the private respondents. It is also relevant to record here that the learned Advocate for the private respondents submits that the private respondents are already enlarged on bail. A report filed in Court today by the Staterespondents indicates that an appropriate case has already been registered under the relevant provisions of
law, giving rise to Dum Dum Police Station Case No. 204/2021, dated February 15, 2021, under Sections 341/323/325/506/34 of the Indian Penal Code and under Sections 24/25 of the Senior Citizens Act. As such, there is no scope of granting any further relief to the petitioner in the present writ petition.
The police authorities shall ensure that the connected investigation is concluded at the earliest. Since affidavits have not been called for, it is deemed that the contentions of the writ petition are denied by the respondents.
W.P.A. No. 3865 of 2021 is disposed of in the light of the above observations without any order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all requisite formalities.
