The petitioner was given liberty to contradict the affidavit filed by the private respondent. No opposition against the affidavit has been placed. Learned counsel for the State respondent submits that the private respondent is not a member of the local bodies, local authorities, Panchayat Raj institution, Board of Corporation or a Member of Legislative Assembly or a Member of Parliament at the time of filing the applications.

Mr. Chatterjee, learned counsel on behalf of the State respondent has submitted a report containing inter alia a report of the Chief Inspector, Food and Supplies regarding the allegation of the petitioner against the private respondent.

I have perused the report. It is reported by the concerned authority that the respondent no.9 has fulfilled all criteria. Hence, he was declared to be eligible.

Considered all the matters and considered the affidavits of the respondent as well as the report of the State authority, I find no justification to entertain the allegations in the writ petition raised by the petitioner. Under the above observation, the instant writ petition is disposed of as devoid of merit.
