The Advocate-on-record of the petitioner undertakes to affirm and stamp the petition/application as per the Rules within four weeks from date. Subject to such undertaking, the application is taken up for hearing.

This is a renewal application for bail in connection with Burtolla P. S. Case No.123 of 2017 dated 01.06.2017 under Sections 302/394 of the Indian Penal Code at the behest of the petitioner.

The earlier bail application was rejected on 8.1.2018 with the prima facie finding of the involvement of the petitioner in the alleged murder of the victim lady. Ten witnesses have already been examined out of twenty seven witnesses and,

therefore, a substantial progress has already been shown in the said case.

Considering the alleged complicity of the petitioner to the offence and the advance stage of the trial, we do not feel that it is a fit case where the petitioner should be enlarged on bail. Accordingly, the prayer for bail of the petitioner is rejected.

However, the learned Sessions Judge is requested to expedite the trial and bring it to its logical conclusion at the earliest.
