Despite order dated 6th February, 2024 and the order dated 15th December, 2004 passed by a Coordinate Bench of this Court, steps have not been take by the learned Advocate for the appellant to put in costs along with written up notice forms with proper address to serve notice on the respondent nos.3(a) and 3(b).

2. The appeal is of the year 1988.

3. The parties are not represented today.

4. It seems to this Court that the appellant is not interested in pursuing the appeal.

5. F.A. No. 446 of 1988 shall stand dismissed for default.

6. Interim order, if any, shall stand vacated.

7. L.C.R., if any, be returned to the Court below.

8. The parties and/or Registry of this Court shall communicate a copy of this order to the Court below for carrying out any directions already pending and passed in the matter.
