Mr. Debangshu Dinda Mr. Arnab Kumar Ghosh ... for the petitioner. This is an application wherein petitioner has prayed for expeditious disposal of A.C. Case No. 428 of 2020 dated 11.02.2020 under section 12 of the Protection of Women from Domestic Violence Act, 2005 presently pending before learned Additional Chief Judicial Magistrate, Alipore. Petitioner's contention is that the instant proceeding was initiated way back in 2020 at the behest of the petitioner/wife but the same has yet to arrive any logical conclusion. The petitioner herein has been running pillar to post to get justice. He further submits that statute mandates that every such application have to be disposed of within 60 days but in the instant case lot of years have been passed but the evidence has not yet been started.

Having heard learned counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made by the petitioner the opposite parties will have no cause to prejudice and as such the service of copy of application upon the opposite parties is dispensed with. Upon consideration of the long pendency of the instant proceeding and statutory mandate laid down in the Act and also invoking this Court's jurisdiction under section 483 Cr.P.C.

preferably within a period of sixty days from the next date of hearing.

CRR 674 of 2025 is accordingly disposed of.
