The petitioner complains that the private respondents are disturbing the possession of his property. He has complained to Minakhan Police Station but in vain.

Counsel for the Minakhan Police Station submits that proceedings under Section 107 of the Code of Criminal Procedure have been taken out after enquiries made to the complaint.

This Court is of the view that the petitioner may pursue his civil remedies against the private respondents in accordance with law.

The Officer-in-charge, Minakhan Police Station shall, however, ensure that there is absolutely no breach of peace in the area.

The instructions in the form of report of Officerin-charge, Minakhan Police Station, Basirhat Police District dated 2nd December, 2022 addressed to the

Government Pleader, High Court, Calcutta is taken on record.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
