Mr. Aniket Mitra, learned advocate, who ordinarily appears for the State, is directed to represent the State. His appointment may be regularised by the concerned authorities.

The present revisional application has been preferred challenging the continuance of Santipur Police Station Case No. 1003 of 2022 dated 24.09.2022 and the charge-sheet submitted therein under Sections 376/417 of the Indian Penal Code. I find that the enclosures to this revisional application only contain the FIR, the letter of complaint and the charge-sheet along with the ordersheets of the learned trial court.

Having regard to the documents which have been enclosed in this revisional application, I am of the opinion that the revisional application is premature. As such, no interference is called for in the present revisional application. However, the petitioner would be at liberty to take out an application in the nature of Section 227/228 of the Code of Criminal Procedure before the jurisdictional court. The jurisdictional trial court would take into account the contentions of the petitioner and dispose of the same in

accordance with law without being influenced by any observations made by this Court while dealing with the present revisional application.

With the aforesaid observations, the revisional application being CRR 485 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
