The learned advocate for the appellant has filed a copy of the written instruction that his client does not wish to proceed with the instant appeal. A written instruction dated 18.04.2024 submitted before the court to that effect be kept on record. The instant appeal arises out of an order of acquittal dated 30.07.1986 passed by the learned Additional Chief Judicial Magistrate, Tamluk acquitting the accused persons for the charges under Section 447/323 of the Indian Penal Code.

Accordingly, the instant appeal is dismissed for nonprosecution.

Department is directed to sent down to the lower court records to the concerned trial court.

Copy of the order be sent to the Department for immediate compliance.
