(NDPS Case No.74 of 2023).

Mr. Neguive Ahmed Mr. Anindya Sundar Chatterjee ... for the State.

Border Security Force personnel names the petitioner as involved in the business of narcotics.

Such personnel names the petitioner to be involved in the incident where, commercial quantity of narcotics was seized. Considering such complicity of the petitioner with regard to commercial quantity of narcotics, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

C.R.M. (A) 503 of 2024 is dismissed.
