Item No.41 In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side 29.03.2022 Ct-24 WPA 3153 of 2022 Marjana Ganguly v.

The State of West Bengal & Ors.

Mr. Sayan De Mr. Kaustav Shome Mr. Sayan Kanjilal ... for the petitioner.

Mr. Biswarup Biswas Mr. Sayantan Hazra ... for the respondent nos. 3 & 4.

Mr. Supriyo Chattopadhyay Mr. Sabyasachi Mandal ... for the State respondents.

The petitioner is aggrieved by certain acts and actions by Debagram Kabi Rabindra Sishu Niketan, a primary school.

The petitioner claims to be a teacher of the said school, who has been dismissed from service.

Learned advocate representing the school submits, upon instruction, that the school is a private school funded by the local people.

As it appears that the school in question is neither a Government School nor receives any grant from the Government, accordingly, the writ petition will not be maintainable against the said institution.

The writ petition, accordingly, stands dismissed. Dismissal of the writ petition, however, will not stand in the way of the petitioner from approaching the proper forum for necessary relief.

It will be open for the institution to adopt all necessary measures to impart quality education to the students.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
